Terms of Services of Choi Brothers Brands

IMPORTANT NOTICE:

This is a legally binding agreement. By using any services provided by Choi Brothers LLC., you agree to be bound by these Terms of Service. If you do not agree to these terms, you are not authorized to use our services.

These Terms of Service (the "Agreement") are entered into by and between Choi Brothers LLC., a Wyoming limited liability company ("Choi Brothers LLC.", "we", "us", or "our"), and you, the client ("Client," "you," or "your").

1. General Terms and Conditions

1.1. Account Information

You are responsible for maintaining the confidentiality of your account information, including your password. You agree to notify us immediately of any unauthorized use of your account.

1.2. Prohibited Activities

You may not use our services for any illegal activities or to host content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or racially, ethnically, or otherwise objectionable. This includes, but is not limited to:

  • Phishing or other forms of fraud
  • Spamming or sending unsolicited bulk email
  • Hosting or distributing malware, viruses, or other malicious software
  • Engaging in copyright or trademark infringement
  • Any form of denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Port scanning, vulnerability scanning, or any unauthorized attempts to access systems

1.3. Acceptable Use Policy (AUP)

All services are subject to our Acceptable Use Policy (AUP), which is an integral part of this Agreement. Our AUP outlines specific rules regarding network usage, resource allocation, and content. You agree to abide by the AUP at all times.

2. Service-Specific Terms

2.1. WormNet (VPS Services)

Service Description: WormNet provides Virtual Private Servers (VPS) with allocated resources. Resources may be subject to fair usage policies to ensure network stability for all clients.

Resource Usage: Excessive CPU, RAM, or disk I/O usage that negatively impacts the performance of other clients on the same host node is strictly prohibited. We reserve the right to suspend or terminate services that violate this policy.

Operating Systems: You are responsible for the installation, security, and maintenance of your operating system and all software running on your VPS.

2.2. Dedicated Servers and Colocations

Service Description: We provide dedicated server hosting where you lease a physical server from us, and colocation services where you provide your own server hardware to be hosted in our data center.

Hardware and Maintenance:

  • Dedicated Servers: We are responsible for the maintenance and replacement of our hardware in the event of failure, unless the failure is caused by your negligence or misuse.
  • Colocation: You are solely responsible for your hardware. We provide power, cooling, and network connectivity, but do not provide hardware maintenance or repair.

Access: Access to the data center facility is restricted and requires prior authorization.

2.3. IP Transit Services

Service Description: We provide IP Transit services, which allow you to connect to our network and access the global internet. The service is provisioned via BGP sessions.

Network Usage: You are responsible for the traffic you transit over our network. You must not send or receive any traffic that violates our AUP or any applicable laws.

Billing: Billing is based on the 95th percentile rule or a flat rate, as specified in your service agreement.

3. Privacy Policy

Effective Date: September 7, 2025

We are committed to protecting your privacy. This policy outlines how we collect, use, and protect your personal information.

3.1. Information We Collect

We collect the following types of information:

  • Personal Information: Name, email address, phone number, and billing information (for payment processing)
  • Technical Information: IP addresses, browser type, operating system, and network usage data for security and network management
  • Service-Specific Data:
    • VPS: Information related to your virtual machine configuration. We do not inspect the contents of your data unless required by law or a valid court order
    • Dedicated Servers & Colocation: Physical address for hardware shipping, and technical specifications of your equipment for our records
    • IP Transit: Traffic and routing data for network analysis and billing

3.2. How We Use Your Information

  • To provide and maintain our services
  • To process payments and manage your account
  • To communicate with you regarding your service and account
  • To monitor and ensure the security of our network
  • To comply with legal obligations

3.3. Information Sharing and Disclosure

We do not sell, trade, or otherwise transfer your personal information to outside parties without your consent, except as described below:

  • Service Providers: We may share information with trusted third-party service providers who assist us in operating our business (e.g., payment processors)
  • Legal Compliance: We may disclose your information if required to do so by law or in response to valid requests by public authorities

4. Refund Policy

4.1. General Refund Policy

We offer a 24-hour money-back guarantee for all new WormNet (VPS) and dedicated server services. If you are not satisfied with your service, you may request a full refund within 24 hours of the initial purchase date.

4.2. Non-Refundable Services

The following services and charges are non-refundable:

  • Colocation Services: Due to the nature of physical space and power allocation, colocation services are non-refundable. All colocation fees are billed in advance and are non-refundable after the service has been provisioned
  • IP Transit Services: All fees for IP Transit are billed based on usage or a flat rate and are non-refundable
  • Setup Fees: Any one-time setup fees, licensing fees, or migration fees are non-refundable

4.3. How to Request a Refund

To request a refund, you must submit a cancellation request through our billing system within the qualifying 24-hour period.

5. Limitation of Liability and Indemnification

5.1. Limitation of Liability

In no event shall Choi Brothers LLC., its directors, employees, or affiliates, be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services.

5.2. Indemnification

You agree to indemnify and hold harmless Choi Brothers LLC. from any and all claims, damages, or expenses (including legal fees) arising from your use of our services, your violation of this Agreement, or your violation of any rights of a third party.

6. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Wyoming.
